Payment Obligations
Graphic Design turnaround begins AFTER PAYMENT and content (pictures, information, etc.) for the project. Design will NOT begin until payment is RECEIVED.
Payments must be made promptly based on agreed schedule. Delinquent bills may be assessed up to a $75 charge if payment is not received within the due date. If an amount remains delinquent 5 days after its due date, an additional 5% penalty may be added for each month of delinquently. Regardless of the place of signing of this agreement, the client agrees that for purposes of venue, this agreement was entered into in St. Petersburg, Florida, US. Please pay on time.
Typical down payment structure may be as follows:
*Projects under $849.00; payment must be paid in full
*Projects over $850.00; deposit 50% required
Payment
Invoices will be provided by THE LEVEL8 AGENCY. Invoices are normally sent via email; however, the Client may choose to receive hard copy invoices. Invoices are due upon receipt.
Print Terms + Conditions
THE LEVEL8 AGENCY, LLC provides a proof of designs PRIOR to sending to print. After proof is approved, THE LEVEL8 AGENCY, LLC is NOT responsible for mistakes in spelling, information, dates, etc.
Refund and Cancellation
THE LEVEL8 AGENCY, LLC does not provide refunds for any monies paid, deposits, web design fees or service fees of any kind. Due to the nature of our business, no refunds will be given. It is your responsibility to make sure you want a product and/or service before purchasing. If, however you place your order and you change your mind, or you need to put your project on hold for a length of time, THE LEVEL8 AGENCY, LLC will issue store credit in lieu of a refund for use at a later date. The store credit must be redeemed within 2 months. Credits that are not redeemed within 2 months will be forfeited to THE LEVEL8 AGENCY, LLC.
Chargebacks
A chargeback is not an acceptable means of attaining a refund and is considered a threat. To request a chargeback on your credit card for a valid transaction is considered fraud. Fraudulent credit card chargebacks will be aggressively prosecuted and reported to all major credit bureaus as a delinquent collection account. Opening a PayPal dispute for a refund will be handled in exactly the same way as a credit card chargeback. THE LEVEL8 AGENCY, LLC will proceed with legal action and collection services against the client, business, and individual person to recover funds. We will also delete any and all files, graphics or materials that we have in relation to the client’s website.
Website Development Cancellation
If site design and development work has already begun (such as planning, creating a design concept, or domain transfer), then the down payment is non-refundable.
DESCRIPTION OF ONGOING COSTS: DOMAIN REGISTRATION AND HOSTING
Domain Registration
This cost recurs annually. Domain name registration gives you exclusive rights to a certain name, such as www.mygroup.org, so that you can use it for your web-based purposes. We DO NOT provide hosting services but we have a list of ones we recommend.
Hosting
This cost recurs annually. Hosting places the domain name on a particular server connected to the web, which allows you to post a website for viewing through a browser. Hosting comes with domain-based emails, bandwidth, storage space, database and security tools, and other features. Prior to coding your site, we require proof and login information for your hosting account.
Website Maintenance
There are no required maintenance fees other than domain registration and hosting. Most people do some work on their site every year, for which we offer several plans. We can make certain parts of the site updatable by you by implementing a custom Content Management System (CMS), or installing a blog. For work we do on the site after going live, we charge on an hourly basis. If you expect that maintenance will be a regular occurrence, you can buy a prepaid maintenance contract that affords a discounted hourly rate. If need be, we can customize a maintenance plan for your particular needs, but no plan is required.
Website Maintenance Payment Obligations
Depending upon the nature of the website changes, prepayment may be required. Should the client be invoiced after the changes are completed, the invoice is due upon receipt. If payment is not received within 5 days, the maintenance changes may be taken down until payment is received. After 60 days, there may also be a $35 reposting fee added to the outstanding maintenance invoice balance.
Training and Tutorials
Because customer service is an integral part of our business strategy, all of our projects include a one-time complimentary training session in order for our clients to better make use of their new web technology. Additional training hours can be purchased at our standard hourly rate or applied against your existing maintenance contract.
Non-Domain-Based Troubleshooting
THE LEVEL8 AGENCY, LLC maintains and troubleshoots the websites we develop for our clients, as well as any domain-based email accounts of those websites. We do NOT assume responsibility for upkeep or provide non-billable troubleshooting on our clients’ ISPs (Internet Service Providers), ISP-based email accounts (name@bresnan.net, name@3rivers.net, etc), your home or office internet connections, or any other non-domain-based issues outside THE LEVEL8 AGENCY, LLC realm of service. Provision of non-domain-based troubleshooting services will be billable at our normal hourly rate.
Indemnity
All THE LEVEL8 AGENCY, LLC services may be used for lawful purposes only. You agree to indemnify and hold THE LEVEL8 AGENCY, LLC harmless from any claims resulting from your use of our service that damages you or any other party.
Legal Notice
THE LEVEL8 AGENCY, LLC does not warrant that the functions contained in the web design project will be uninterrupted or error-free. The entire risk as to the quality and performance of the web design project is with the client. In no event will THE LEVEL8 AGENCY, LLC be liable to the client or any third party for any damages, including, but not limited to service interruptions caused by Acts of God or any other circumstances beyond our control, any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate this web design project, failure of any service provider, of any telecommunications carrier, of the Internet backbone, of any Internet servers, your or site visitor’s computer or Internet software, even if THE LEVEL8 AGENCY, LLC has been advised of the possibility of such damages.
